The government said it had hired a research firm to track down Musk’s address and had contacted one of Musk’s lawyers.
The attorney had waived requests for personal service of legal documents in previous federal lawsuits, according to filings.
“The government contacted Mr. Musk’s attorney by email asking if he was authorized to act on Mr. Musk’s behalf in this matter, but did not receive a response confirming or denying authority.” stated in the submitted documents.
Musk did not immediately respond to CNBC’s request for comment.
But on Monday night, Musk responded to Twitter user @unusual_whales who tweeted the story.
“This is ridiculous on so many levels,” Musk wrote in a reply to Twitter. “1. The financier didn’t give me any advice. 2. The idea that I need or need financial advice from stupid scammers is ridiculous.”
“3. JPM let Tesla down 10 years ago, even though it had Tesla’s global commercial banking business, after which we exited the business,” Musk wrote. “I never forgave them.”
In 2018, Epstein said, New York Times reporter James Stewart said he advised Musk after the Securities and Exchange Commission opened an investigation into Mr. Musk’s comments about taking the company private.

When contacted by The Times for comment, Tesla strongly denied the allegations, saying it was “wrong to say that Epstein advised Elon about anything.” Epstein predicted to Stewart that “everyone at Tesla would refuse to talk to him or be friends with him,” according to an article about the interview.
Epstein, a former friend of Donald Trump’s Bill Clinton and Britain’s Prince Andrew, was a client of the bank from 1998 to 2013. In 2008, he pleaded guilty to a state charge of soliciting sexual acts from an underage girl in Florida.
Epstein committed suicide in a Manhattan prison in August 2019, a month after being arrested on child sex trafficking charges.
