President Biden’s decision to use executive authority to pardon his own son on Sunday will be a notorious decision in presidential politics. It’s not just that the president exercised his constitutional authority on behalf of his family. This action is the culmination of years of lying to the public about his knowledge and intentions regarding the influence-spreading scandal surrounding his family. Even amid past controversies over the use of this pardon power, Biden has cemented his legacy to many not as commander-in-chief but as a lying commander-in-chief.
Despite its noble origins and purpose, the pardon power has not been a primitive power historically used by presidents. like i have I wrote it beforeused to benefit the political cronies of past presidents. President Warren Harding was even accused of selling pardons involving mob enforcer Ignacio Lupo, known as “Wolf Lupo.” Former President Bill Clinton waited until the final days of his presidential term to pardon his brother and a major Democratic donor. President Trump also pardoned Charles Kushner, the father of his son-in-law Jared Kushner. (Charles Kushner was also recently selected as President Trump’s special envoy to France.)
In 2023 I I wrote Biden may follow this same pattern and pardon his son as a lame duck president. The president lied during the election, during presidential debates, and throughout his term.
Afterwards, reporters repeatedly asked him if he intended to forgive his son. The president was running for re-election and lied again. He and the White House have repeatedly said no such pardon has occurred or is being considered. That was also a lie. The pardon power is written in absolute terms and, in my view, the president can even pardon himself. However, what is constitutional does not necessarily mean what is ethical and right. The president has now pardoned Hunter for the felonies he was convicted of and crimes he may have committed between “January 1, 2014 and December 1, 2024.”
It is now being buried under a comprehensive immunity deal and a series of presidential lies.
