CEO Jamie Johnson told members in an email that the MLS and PCBR boards wrote a letter to NAR in August informing the national trade association of the decision.
NAR’s clear cooperation policy was established in 2020. Under this policy, listing agents are required to submit a home to the local MLS within one business day of putting it on public sale.
“We have notified NAR that we will not comply with the policy requirements until the policy committee meets to determine potential changes to the policy,” Johnson’s email to members said. . “However, due to core standards requirements from the NAR, we have told the entire membership that we will wait until after the NAR policy committee discussion before making a formal announcement. We are not enforcing this policy at this time. However, we can honestly say that we have never charged agents who have violated this policy in the past.
Historically, if a member contacted PCBR about a possible violation, the association would ask the agent to register with MLS, according to Johnson’s email. That request was always complied with, it said.
“Our regular MLS policy still requires agents with listing agreements to list on the MLS unless they have a signed right to withhold the form from the seller,” she wrote.
