“The president has no authority to terminate members of the National Labor Relations Committee of voluntary circumstances. His attempt to fire his plaintiff from the board’s position was a blatant violation of the law,” Judge Beryl Howell wrote in an order Thursday in the U.S. District Court in Washington, D.C.
Hours after the ruling, Trump filed an appeal of the decision with the U.S. Circuit Court of Appeals in D.C. The dispute could end in the Supreme Court.
The NLRB, created by Congress, is responsible for enforcing US labor laws.
Wilcox, who was the first black woman to date, was also the first NLRB member to be fired by the president in the agency’s 90-year history.
Trump replaced her as another board member and chair on the first day he returned to the White House on January 20th, and a week later fired her and top NLRB lawyer Jennifer Abruzzo in a late-night email.
According to the email, Wilcox, who was the appointee of former President Joe Biden, said that “the head of an agency within the administrative division was fired because they had to share the purpose of the agency. [Trump’s] management. “
But Howell said in Thursday’s ruling that Trump “interprets the scope of his constitutional power, or more appropriately, his desires are wrong.”
“The president of America is not a king, and not even a ‘elected’ one. And while his power to eliminate federal officials and honest civil servants like plaintiffs is not absolute, he may be constrained by the right situation as is here,” Howell wrote.
“Presidents who promote their image of themselves as “king” or “dictator” as perhaps an effective leadership vision is fundamentally misconstrued by their role under Article II of the US Constitution.” Article 2 is a section of the Constitution detailing the enforcement power of the presidency.
“This decisive victory firmly rejects the extreme president’s grip on power,” Wilcox’s lawyer Deepak Gupta said in a statement.
“Today’s decision is a victory not only for Wilcox, but also for the integrity of the National Labor Relations Commission and its important mission to protect American workers,” Gupta said in a statement.
“The court has strengthened key legal protections for independent bodies designed to ensure parliament is fair.”
The White House did not immediately comment on the ruling.
The ruling comes hours after special advisor Hampton Dillinger’s top federal ethics watchdog, said it was dropping a legal battle to reverse Trump’s firing.
On Saturday, another U.S. District Judge in Washington, D.C. held that Trump’s termination of Dillinger was illegal.
However, a three-judicial panel on the D.C. federal court of appeals said Dillinger could be removed from his post until the results of an appeal by the Justice Department challenged the lower court’s decision.
