Today’s hottest trend for policymakers is around artificial intelligence. This incredibly powerful technology is here to stay, and new research shows most of us are optimistic about how generative AI can improve our lives.
However, there are some new and worrying threats that policymakers must pay attention to. This includes horrific abuses of this positive technology. This means that malicious actors can exploit his AI to put real people, including minors, into sexually explicit situations.
This criminal use of AI tools is not just reprehensible; It can destroy human life and dignity. There are currently gaps in the laws addressing this type of behavior that could potentially let the bad guys go free, and policymakers need to address this issue now to ensure perpetrators are held appropriately accountable. Many of the ways that bad actors abuse AI tools are already illegal under hundreds of laws. If AI is used to commit fraud, there are laws against fraud. The same goes for the use of AI for unlawful discrimination, and the list goes on.

All existing laws apply to AI as well as offline consequences. But the gulf does exist, and Americans are hurting.
Such gaps remain when it comes to prosecuting predators who traffic in sexually explicit images of minors. Current law requires such images to be actual live shot photographs. These holes in our laws can provide dangerous hiding places for criminals, allowing them to hide behind the letter of the law while watering down its spirit. Legislative consideration is therefore warranted and urgently needed. Rather than banning or over-regulating AI with a wish list of red tape, lawmakers should close holes in existing laws to ensure criminals cannot circumvent AI to abuse innocent people. Action should be taken to stop this.
The first step for policymakers is to enact anti-deepfake CSAM laws. This simple bill would update existing child protection laws to make it clear that it would be illegal for criminals to use AI to “alter” sexual images of children. If you’re using real children, this is child pornography, even if the rest is AI-generated. It’s illegal and policymakers must ensure these predators go to prison.
Second, approve the bill to end the non-consensual distribution of intimate deepfake media. It updates existing state privacy laws to clarify that it is illegal to distribute personally identifiable AI images with the intent to cause harm, and addresses serious concerns about horrific harassment from “deepfakes.” It is something to do.
