The situation between Nikki Garcia and Artem Chigvintsev is deteriorating.
On Monday, Garcia filed for a restraining order against the “Dancing with the Stars” alum, which a judge approved.
Among the submitted documents, we obtained the following: TMZGarcia claimed that Chigvintsev “tackled me multiple times and pinned me to the ground while the child was present.”
Nikki also detailed the circumstances surrounding Artyom’s arrest on August 29th.
According to documents, the two got into an argument over how to toast their son Matteo’s English muffins.
Nicki admitted that she threw Matteo’s shoe at Artem during a heated argument, but claimed that the shoe was too light to cause any injury or pain.
Nikki claimed that Artem grabbed Matteo and took him upstairs to a bedroom in retaliation.
When she tried to force his way into the room, Chigbinstev allegedly opened the door and held her to the floor for about 30 seconds.
Nikki claims Artem closed the door again, and when she refused to stop trying to get into the room, he put his hand on her chest, making her feel like she was suffocating. She also said he tried to fight her off by grabbing her by the neck.
Police eventually arrived and took Artem into custody after Matteo said “daddy hurt his hand,” according to the filing.
Along with the restraining order, Nikki wants Artem to undergo therapy and anger management.
Due to the restraining order, Chigvintsev must stay at least 100 yards away from Garcia and Matteo. He will only be able to get closer if he has a visit or interaction with Mateo.
The restraining order was issued just weeks after the Napa County district attorney dropped domestic violence charges against Artem.

Haley continued, “We are required to prove all criminal charges ‘beyond a reasonable doubt,’ which is the highest standard in the American criminal justice system.” Available Evidence If it does not reach this level of evidence, it cannot be ethically prosecuted. ”
Haley said the decision not to file criminal charges was made after a “thorough review” and “evaluation of the evidence.”
According to court records in August, Chigvintsev was charged under California Penal Code 273.5(a), which includes bodily injury to a spouse.
