More than 10 million home sellers have already received or will soon receive notice that they may be entitled to receive commission settlements proposed by a small number of real estate agents.
JND Legal ManagementThe firm appointed by the lawyers to oversee administrative work on the commission case, known as Gibson, According to additional legal documents provided to Inman by JND, more than 10 million postcard notices and 27 million email notices have been sent to potential plaintiffs since March.
To further reach out to potential litigants, JND is running an advertising campaign in print, television and digital media, highlighting both the size of the settlement and the fact that it is moving forward outside of court, according to the documents.

Alternatively, they can request not to be included in the settlement or object to the settlement by October 3rd.
A final hearing on the settlement between Compass, Real, Redfin, Realty One, @properties, Douglas Elliman, Engel & Volkers, HomeSmart and United Real Estate is scheduled for Oct. 31.
Not all of the brokerages named in the Gibson lawsuit have reached settlement agreements, and the settlement total could increase in the coming weeks. EXp Realty is the largest brokerage that has yet to reach a settlement agreement.
Home sellers may be eligible if they listed their home for sale in the following areas and during the following time periods:
- Listed in the MLS of Alabama, Georgia, Indiana, Maine, Michigan, Minnesota, New Jersey, Pennsylvania, Tennessee, Vermont, Wisconsin, or Wyoming between October 31, 2017 and July 23, 2024
- Nevada MLS from January 15, 2018 to July 23, 2024
- In any MLS in Arkansas, Kentucky or Missouri between October 31, 2018 and July 23, 2024
- From October 2, 2019 in the California MLS July 23, 2024
- Listed on the MLS between October 31, 2019 and July 23, 2024 anywhere in the United States except the states listed above.
Collectively, the real estate firms mentioned above have agreed to pay a combined total of more than $110 million. If you include settlement payments from the National Association of Realtors, HomeServices of America, Keller Williams and others, the total comes to more than $730 million.
Plaintiff’s lawyers are entitled to receive up to 33.3% of the total amount plus actual costs incurred during the litigation.
