Less than a week after an amended complaint added numerous new plaintiffs to the Davis Home Buyers Board lawsuit, the judge presiding over the case dismissed the defendants’ complaint. Hanna HoldingsMotion to dismiss or transfer the action.

In the motion, the brokerage also requested that if the court does not dismiss the lawsuit, it should be transferred to the Western District of Pennsylvania.
The lawsuit, originally filed in late May by plaintiff Scott Davis, National Association of RealtorsThe “participation rule” requires listing brokers to offer buyer’s brokers a lump sum compensation to list a property on an MLS affiliated with a real estate association. Plaintiffs allege that this rule has resulted in higher commissions and increased the overall cost of the transaction.
Earlier this month, Davis said: Coleen TilleryThe same company that filed the two Baton Home Buying Committee lawsuits has filed an amended complaint, adding 25 new plaintiffs to the lawsuit, many of whom are also plaintiffs in the Baton and Latz Home Buying Committee lawsuits.
