President Biden’s administration will allow Washington state to provide health insurance to illegal immigrants within its borders by rescinding the Affordable Care Act (ACA) requirements.
The Treasury Department and the Department of Health and Human Services (HHS) approved the state’s request through a state innovation waiver requested by the Washington state government in May.

State Innovation Waivers are granted under HHS and Treasury oversight to states seeking to modify existing ACA regulations to meet specific needs.
“Section 1332 of the Affordable Care Act (ACA) allows states to apply for the State Innovation Waiver (also known as the Section 1332 Waiver) to maintain basic health coverage while providing access to high-quality, affordable health insurance. We are allowing it to pursue innovative strategies to provide residents with access to the protection of the ACA,” according to Medicare and Medicaid Service Center.

In a statement, departments said the approved amendments to Washington’s ACA will be in effect from 2024 to 2028, subject to states accepting “certain conditions.”
