According to a lawsuit obtained by CNN, an unarmed black man who was shot dead by a police officer in Shreveport, Louisiana, was suing police for alleging excessive force.
Alonzo Bagley, 43, was killed earlier this month after officers responded to a domestic disturbance call at his apartment, according to Louisiana State Police. When police arrived, Bagley fled by jumping off the apartment balcony, and after a short foot chase, one officer fatally shot Bagley.
The officer is on paid leave and state police are investigating the incident, which includes reviewing the officer’s body-worn camera.
Documents show Bagley had a run-in with Shreveport police years before he was murdered.
Twelve months after Shreveport police allegedly assaulted Bagley during his January 2018 arrest, he filed a federal lawsuit against the department.
Bagley required treatment for “a fracture of the occipital orbital bone, bruising on the head and face, and knocking out many upper front teeth.” Suit says.
During the 2018 incident, officers responded to a domestic dispute between Alonzo and his wife, the complaint says.
Bagley was put in He moved his hands in front of his body “because of the pain and discomfort of being handcuffed behind his back in the backseat of an SPD (Shreveport Police Department) police car,” Suits said. According to the filing, he “wasn’t trying to run away, he didn’t try to run away, he just repositioned himself from the painful position he was in.”
One officer then opened the door and “struck him in the head and face with several shots,” but the second officer did not stop the assault, the lawsuit said. Bagley was handcuffed throughout and offered no resistance, the lawsuit states.
In response to the complaint, the city said one of the officers had opened the patrol car’s door, but was helping Bagley because he “tried to choke or choke him with his seatbelt.”
The city went on to state that the officer punched Bagley in the head and face when he covered his head with his arms and prevented Officer Kolb from removing his seatbelt and exiting the vehicle. He said.
It is unclear what the settlement of the lawsuit was.
The attorney representing Bagley in the case did not call CNN for comment.
Bagley was charged with domestic abuse battery and resisting officers in connection with the incident. Domestic abuse charges were dismissed and he pleaded guilty in February 2018. According to court records, he resisted the officers.
CNN reached out to police for comment and filed a public records request with the city to find out more about the 2018 incident.
Alexander Tyler, the officer who shot and killed Bagley earlier this month, was not in the department when the 2018 incident occurred.
Bagley’s family sued Tyler, The lawsuit, filed in federal court, seeks more than $10 million in damages. The lawsuit alleges that the firm violated Alonzo Bagley’s Fourth Amendment rights.
Louisiana State Police say the incident is still under investigation.
