More than a month after his arrest, Artyom Chigvintsev is not expected to face charges of domestic violence.
According to the press release: Us Weekly“We take these arrests seriously and are staunchly opposed to domestic violence, but we have an ethical obligation to only file charges when supported by the evidence,” Napa County District Attorney Alison Haley said Tuesday.
Haley continued, “We are required to prove any criminal charge ‘beyond a reasonable doubt,’ which is the highest standard in the American criminal justice system. If the available evidence does not meet this level of proof, we cannot ethically bring charges.”
Haley said the decision not to file criminal charges was made after an “exhaustive review” and “evaluation of the evidence.”
According to July court records, Chigvintsev was charged under California Penal Code 273.5(a), which includes bodily injury to a spouse.
The “Dancing with the Stars” pro was released from jail after posting bail.
Then, TMZ Obtained A radio call revealing details of the incident.
According to the dispatcher, Artem called 911 and said “he and his wife had been arguing and she threw a shoe at him.”
The dispatcher added, “There is a child on scene. An ambulance is on the way. 415 is in operation.” [disturbing the peace] There is responsibility behind it.”
The operator then said they were “attempting to separate the two,” and added, “RP states no medical attention is required at this time.”
Following Chigvintsev’s arrest, his wife, Nikki Garcia, filed for divorce, citing irreconcilable differences.

Nikki requested full custody of their 4-year-old son, Matteo, and asked the court not to award spousal support to either spouse.
Artem responded to the documents, seeking spousal support from Nikki and joint legal and physical custody of Matteo.
Chigvintsev also asked Garcia to pay his attorney’s fees.
