Lyle and Eric Menendez will spend Thanksgiving and Christmas in prison.
On Monday, Judge Michael Jessick announced that the retrial would be postponed to late January “out of respect for the new administration.”
New Congressman Nathan Hockman will be sworn in on December 2nd, but President Trump will not be in the White House until January 20th.
The judge also noted that more time is needed to consider all new evidence in the case.
Both sides agreed to a new hearing date for January 30-31, but the judge has not yet officially announced the date.
After some technical issues, the brothers appeared in court virtually, their first appearance in court in 28 years.
At Monday’s hearing, Eric and Lyle’s aunts, Joan Andersen Vandermolen and Teresita Barart, testified and appealed for their release.
Vandermolen, who turns 93 tomorrow, told the judge: “I love Eric and Lyle and I want them to come home. They’re worried that tonight will be the night they get raped.” Please, I had no idea. It’s time for them to go home.”
Mr. Barart added: “Thirty-five years is a long time. I think it’s time for them to go home.”
The brothers’ attorney, George Geragos, asked Gov. Gavin Newsom for leniency in suspending Hochman’s decision.
In 1996, Lyle and Eric were convicted of murdering their parents Jose and Kitty Menendez in Beverly Hills in 1989.
The murder case is receiving renewed interest thanks to Ryan Murphy’s sensational Monsters: The Story of Lyle and Erik Menendez and the Netflix documentary The Menendez Brothers.
Prosecutor George Gascón recommended re-sentencing in October, but lost re-election earlier this month.
